1. Introduction
Welcome to KAZA Nearby ("we," "our," "us"). By accessing or using our website, Android, or iOS application ("Platform"), you agree to these Terms and Conditions ("Terms"). KAZA Nearby is an online platform that connects users ("Buyers" or "Users") with verified independent service providers ("Providers") for various home-related services such as plumbing, electrical work, cleaning, carpentry, and more.
2. Eligibility
To use KAZA Nearby, you must: be at least 18 years old; provide accurate and complete information during registration; and comply with these Terms and applicable laws in India.
3. Account Registration
Users are required to create an account to access and book services. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. KAZA Nearby reserves the right to suspend or terminate accounts that violate our policies or engage in fraudulent activity.
4. Services Offered
KAZA Nearby provides a digital platform for users to browse and book verified service providers, bargain and finalize service costs, and make secure payments through our payment gateway. We act solely as an intermediary — facilitating connections and transactions between users and providers. We do not employ the service providers directly.
5. Service Providers
All providers are independent contractors, not employees of KAZA Nearby. Providers are responsible for the quality, timeliness, and safety of their work. KAZA verifies providers using government-issued ID and business proof (Aadhaar, PAN, etc.), but we cannot guarantee the accuracy of every detail.
6. Payments & Fees
Payments for services are handled through our integrated payment gateway. KAZA Nearby charges a 5% commission from service providers on each completed transaction. Users are required to make payments in full before service confirmation unless otherwise specified.
7. Cancellations & Refunds
Users can cancel a service before the provider has started the work. Refunds may be processed only if the provider fails to show up or complete the service, or if a genuine issue arises and is verified by KAZA's support team. Refunds will be issued to the original payment method within 7–10 working days after validation.
8. User Conduct
Users agree not to post false, misleading, or illegal requests; harass or threaten service providers; or attempt to misuse or hack the KAZA Nearby platform. KAZA reserves the right to suspend or permanently ban users for misconduct.
9. Liability Disclaimer
KAZA Nearby only provides a platform to connect buyers and service providers. We are not responsible for damages, losses, or disputes arising during service execution. Any claims or issues must be resolved directly between the user and the provider. However, our support team will assist in mediation when necessary.
10. Termination
KAZA Nearby may suspend or terminate your account if you violate any terms or misuse the platform. We reserve the right to refuse service to anyone at our discretion.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of India, with jurisdiction in Kolkata, West Bengal.
